Erazme Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Erazme digital-legacy management platform (“Erazme”, “we”, “us”, “our”), operated by Alton Estates Ltd, a company registered in UK.
By creating an Erazme account or using our services, you agree to be legally bound by these Terms.
1. About Erazme
Erazme is a digital-legacy and digital-estate instruction service. We provide a secure platform that enables clients to store information, designate a trusted Executor/Named Person, and create formal instructions relating to the handling of their digital accounts, files, and online presence upon incapacity or death.
Erazme does not provide legal, financial, or estate-planning advice. All decisions relating to digital assets remain your responsibility.
2. Eligibility
You must be:

at least 18 years old,
-
legally capable of entering into a binding agreement, and
-
the lawful owner/controller of the digital accounts and directives you upload or register with Erazme.
3. Your Account and Security
You are responsible for:
-
ensuring that all information you provide is accurate and up to date;
-
maintaining the confidentiality of your login credentials;
-
restricting access to your device(s) and account.
Erazme is not responsible for unauthorised access resulting from your failure to maintain secure credentials.
4. Executors and Named Persons
You may nominate one or more individuals (the “Executor” or “Named Person”) within your Erazme profile.
By adding this individual, you confirm that:

they have your permission to activate and instruct Erazme regarding your stored directives upon your death or incapacity;
-
Erazme may rely fully on these instructions once identity verification is completed;
-
Erazme may act without further approval from your estate.
You are responsible for ensuring your Executor/Named Person is informed of their role and that their contact details remain current.
5. Activation of Your Instructions
Upon being notified of your death or incapacity, your Executor/Named Person may request activation of your stored directives.
Erazme will:

take reasonable steps to verify the identity of the Executor/Named Person;
-
perform the actions you have stored and authorised, subject to these Terms;
-
reserve the right to request evidence (e.g., death certificate, medical confirmation, or other documentation) before proceeding.
Erazme is entitled to act in good faith on verified Executor instructions.
6. Services We Provide
Depending on your plan and instructions, Erazme may:

provide secure storage of digital-legacy directives and digital account details;
-
notify your Executor/Named Person as authorised;
-
act upon your digital instructions (e.g., closure requests, memorialisation requests, deletion tasks, information transfer actions);
-
provide support to Executors during activation;
-
supply documentation or evidence to service providers as part of your directives.
We cannot guarantee that third-party platforms (e.g., Google, Meta, Apple, banks, cloud providers) will accept or implement deletion or memorialisation requests. Their own terms and policies apply.
7. Charges and Fees
By opening an account, you agree to:

any subscription fees applicable to your chosen plan;
-
the service charges and administrative fees that apply when your Executor activates your instructions;
-
additional fees for exceptional or manual processing, where appropriate.
Fees are disclosed on the Erazme website and may be updated from time to time.
Your Executor authorises Erazme to invoice the estate for activation and processing charges.
8. Data Protection & Privacy
We take data security seriously. Erazme complies with applicable data-protection laws, including UK GDPR and Data Protection Act 2018.
We will only process your personal data:

to provide the Erazme service;
-
to act on your stored instructions;
-
as legally required.
You may request data deletion at any time, subject to the operational nature of your account.

9. Your Responsibilities
You agree that:

all information submitted to Erazme is lawful, accurate, and owned by you;

you will not store login credentials that you are not permitted to share;
-
you will not upload prohibited or harmful content;
-
you will update your Executor/Named Person details as necessary.
You also acknowledge that digital platforms may require additional legal documents (e.g., probate, court orders), and Erazme cannot bypass legal requirements.
10. Limitations of Service
Erazme cannot:

guarantee acceptance of digital-legacy requests by third-party companies;
-
access accounts or complete actions that require direct passwords (unless you have explicitly stored them and permitted such access);
-
perform actions that violate applicable law or terms of third-party service providers.
Erazme is a facilitator—not a legal executor of your estate.
11. Liability
Erazme/Alton Estates Ltd is not liable for:
-
actions taken in good faith relying on verified Executor instructions;
-
changes to third-party policies;
-
indirect or consequential losses;
-
unauthorised access resulting from your failure to secure your account.
Where legally permitted, our total liability shall not exceed the total fees paid by you in the previous 12 months.
Nothing in these Terms limits liability for fraud or any matter that cannot be excluded by law.
12. Termination
You may close your account at any time.
Erazme may suspend or terminate accounts for:

breach of these Terms,

misuse of the platform,
-
non-payment, or
-
unlawful activity.
Upon termination, stored directives and data will be deleted unless legally required otherwise.
13. Changes to These Terms
Erazme may update these Terms from time to time.
We will notify you of material changes. Continued use of the service constitutes acceptance of updated Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
